Stadifit (located in Bulevardi 54, 00120 Helsinki) is a part of Idealfysio Oy (2615378-5) . By starting a membership with Idealfysio Oy or using Idealfysio Oy’s services, you agree to these terms and conditions at the same time.

DISCLAIMER

1) We urge you to avoid physical activities that are not suitable for you for health reasons. If you feel that your condition is limiting your training, talk to your doctor before starting. Our training programs and training facilities are made as safe as possible, but all members train at their own risk. Members are required to assess their own health and, if necessary, participate in the teaching of basic techniques before practicing at Idealfysio.

2) Disclaimer issued by the customer to Idealfysio Oy: The customer acknowledges that the training programs and nutrition training services he/she has purchased can include heavy physical activity, running, weight training, cycling, gymnastics and adherence to nutrition programs, etc. The customer is aware that these physical activities could cause heart attack, muscle twitching, fracture, heat stroke, knee, lower back and leg injury or other illness. The client declares that he/she does all the training at his/her own risk. By starting a membership the client also confirms that he or she is able to participate in physical training and has discussed with Idealfysio Oy staff what is the appropriate form and program of training. The customer declares that he/she takes responsibility and risk for exceeding his/her own physical tolerance.

3) The member, his or her heirs or relatives waive the claims and release Idealfysio Oy (and any of its owners, employees or other authorized representatives, including independent contractors) from liability for all damages and claims.

4) The Member agrees that all terms and conditions of this Agreement shall be binding on the Member's heirs, personal representatives and principals.

5) Enforceability: The parties agree that if any provision of this agreement is held to be void and unenforceable, such provision shall be deemed to be detached from this agreement, which shall otherwise remain in full force and effect. However, the member agrees that all terms and conditions will be met and the member expressly waives any statutory right that will invalidate the enforceability of a provision of this agreement.

GENERAL TERMS AND CONDITIONS

1) Members must always follow the rules of membership and agree to all reasonable instructions given by the staff to ensure the operation of Idealfysio Oy, the appropriate use of the premises and the comfort of other members.

2) All costs incurred by members during their visit to Idealfysio Oy must be paid before leaving the premises or hours, unless the invoicing of products or services has been agreed separately.

3) All disputes and disagreements shall be interpreted as binding on the parties by the person in charge of Idealfysio Oy. Those who are dissatisfied with the interpretation can apply to the Helsinki District Court for a solution.

4) Idealfysio Oy reserves the right to change the rules at any time without separate notice to individual members. If any part of these rules is declared illegal or otherwise unenforceable, the remaining provisions will remain in full force and effect.

USE OF FACILITIES

1) Once the customer has acquired a membership key tag, he/she has the right to use Idealfysio Oy's premises. Idealfysio Oy may at any time close all or part of its premises without prior notice, if necessary, for cleaning, repair, modification, maintenance or safety measures or for reasons beyond their control.

2) If the customer has an accident at Idealfysio Oy's premises, he/she must notify the staff member of the accident and the circumstances that led to it immediately after the accident.

3) Clothing should always be appropriate.

4) Access to the gym and booking of courses can be done using personal login information in the online booking software.

5) Members who sweat profusely are advised to act in a manner that does not disturb other members and to wipe the equipment after use.

6) For safety and hygiene reasons, cutlery, glasses and utensils are not allowed in the training areas.

7) In the case of a fire, members are asked to leave calmly using the nearest exit.

8) Under no circumstances will Idealfysio Oy, coaches, employees or other personnel (including all independent operators employed by Idealfysio Oy) be liable for any loss, injury or accident (including death), accidental or wilful misconduct of members caused by or in other circumstances when using Idealfysio Oy's premises.

9) Smoking - Smoking is prohibited in the area of Idealfysio Oy.

10) Social Events - Idealfysio Oy reserves the right at any time, without notice, to restrict facilities to events that restrict normal customer use of the facilities.

11) Lost property - All lost property from Idealfysio Oy's premises must be delivered to Idealfysio Oy's staff. The items will be kept for a month, after which they will be donated to a local charity. Idealfysio Oy's liability for loss of or damage to customers' property is limited to damage and loss caused solely by the negligence of Idealfysio Oy, its personnel and representatives. Without exception, Idealfysio Oy does not take responsibility for money, valuables or other personal property of members.

12) Deliberate dismantling of Idealfysio Oy's premises, theft or misuse of property will result in immediate termination of membership and a possible notification to the authorities.

MEMBERSHIP, SERVICES, PRICING AND BILLING

1) In the event of any price changes to existing memberships, the price change will be announced in advance. The customer may, if he/she wishes, terminate his/hers membership within the given period before the price change takes effect.

2) The information, services and products provided on and around the website are subject to change without notice. We reserve the right to cancel the offer in the event of a website error or incorrect information. We also reserve the right to cancel all accepted orders placed under error or misinformation. All products offered are subject to availability.

3) By paying the membership fee and accepting these terms of use, the member is entitled to use Idealfysio Oy's facilities and / or services in a manner and to the extent appropriate to the type of membership.

4) Payment of the membership is made either in full at the beginning of the membership or monthly, always the following month in advance with payment by invoice. If a member pays for his or her membership in advance on a monthly basis, an invoice will be paid for the first month of training at the beginning of the membership, which is determined as follows: day, at the start of membership, a training fee will be paid from the start date to the last day of the current month, either on-site at the facility or by invoice. If the membership starts on the 15th-31st of the month, the training fee will be paid either on site at the facility or by invoice from the start date with last day of the following month. Thereafter, the training fee will always be sent to the member on a monthly basis 14 days in advance of the invoice due. The due date of the invoice is the 1st day of the month.

If payment is not made by the due date, a payment reminder will be sent 7 days after the due date. If payment is not received within 7 days of the late payment notice, the invoice will be sent to the external operator's debt collection service and membership will be blocked. Membership will be reopened when payment is received.

5) A Member shall be deemed to have breached this Agreement if it fails to comply with the terms of this Agreement, including but not limited to the obligation to make payments on the due date, as set forth above. By default, Idealfysio Oy has all available rights and remedies, including termination of this agreement and compensation for all applicable damages. If Idealfysio Oy delays or refrains from exercising its rights under this agreement, Idealfysio Oy will not transfer or Idealfysio Oy will not lose these rights. If Idealfysio Oy accepts the member's payments late or in part, Idealfysio Oy does not transfer the right to receive payments and other expenses in accordance with this agreement.

6) Payment methods: we accept cash and most types of benefit payments (Smartum, ePassi and Edenred, etc.). Membership account payments can also be handled by e-invoice, bank transfer, and debit or credit card.

7) Idealfysio Oy reserves the right to reject an application for membership or deny access to the facility at the discretion of management.

8) When you register your membership, you will be given a key tag. If you register your membership on our website, you will receive a key tag on your first visit to Idealfysio Oy. If the key is lost, the price of a new key is 10 euros. Purchasing a new key tag is possible during Idealfysio Oy's reception opening hours. All members must use the key to register for the gym and courses each time they visit Idealfysio Oy. Remember that the key is for personal use only; you are not allowed to bring non-members to the gym with you. Also, for security reasons, you are not allowed to open the door for another person, even if they say they are members. If these rules are violated, membership will be terminated immediately without compensation.

9) Purchasing a membership or service from Idealfysio Oy's online store:

Idealfysio Oy's online store complies with the Distance Selling Act. The customer making an online store purchase accepts Idealfysio Oy's valid terms and conditions. The online store purchase can be canceled within 14 days of the purchase by notifying the cancellation by e-mail to asiakaspalvelu@stadifit.com. In this case, the purchase will be canceled and the customer will be refunded the amount paid in connection with the online store purchase. The right of cancellation is valid if the customer has not used the service (meetings with the coach have not yet been held, the gym key tag has not been collected or guided classes have not yet been attended).

TERMINATION / SUSPENSION OF MEMBERSHIP

1) Idealfysio Oy reserves the right to deny access and / or suspend or suspend membership immediately if a member: a) causes disturbance or undue disturbance to Idealfysio Oy to other members or guests of Idealfysio Oy b) violates Idealfysio Oy c) misuse Idealfysio Oy's premises, c) for any other reason that is contrary to Idealfysio Oy's rules or values.

2) Member's right to terminate membership: The customer may not terminate or cancel the agreement and current membership earlier than within the time limit set by the selected membership, unless: a) the member is unable to take full advantage of Idealfysio Oy's services due to death or injury (b) all memberships include a risk-free withdrawal period of 7 days. If the member decides to cancel the service within 7 days of signing the contract, he will receive a 100% refund of the money paid. Any refunds apply only to cash or card payments, not to payments made with sports benefits (ePassi, Smartum, etc.).

3) The member has the right to suspend the service: membership may be suspended in the following cases: a) for medical reasons (which requires a written medical certificate and applies from the date of the certificate). A medical certificate is also required for rehabilitation. b) By type of membership (see Special Conditions of Membership) c) In exceptional circumstances. All suspensions of memberships are made at the discretion of management.

SPECIAL CONDITIONS FOR GYM MEMBERS AND SMALL GROUP TRAINING MEMBERS

Commitment period

Gym and small group coaching memberships are agreements valid until further notice. Membership automatically continues as an ongoing membership with one (1) month's notice.

Pausing the membership

Membership can be paused maximum two (2) times per calendar year. The minimum length of the pause is fourteen (14) days and the maximum length is six (6) months. The request for a pause must be notified in writing to asiakaspalvelu@stadifit.com. Customers will be sent an invoice for the following month in the middle of the month. If the pause request has been announced on the 1st-15th of the month, the pause will be notified in the next invoice. If the pause request has been announced on the 16th-31st of the month, the invoice already sent needs to be paid normally. Any days overlapping the pause will be credited in the next invoice to the customer when the membership is active again. At the end of the pause, membership and billing will be automatically active.

Termination of membership

Membership can be terminated with one month's notice. If a member wishes to terminate the membership on the 1st-15th of the month, membership ends on the last day of the same month. If a member wishes to terminate the membership on the 16th-31st of the month, membership ends on the last day of the following month. Notice of termination must be given in writing to asiakaspalvelu@stadifit.com. The gym key tag must be returned to Idealfysio Oy within two weeks of the end of the membership.

Hourly bookings

1) Hourly bookings can be made 5 days in advance from the web portal. Cancellations must be made for the morning and morning hours 12 hours before the start of the hour and for the afternoon and evening hours 6 hours before the start of the hour.

2) Classes will be canceled if no bookings have been made within the booking period. If the class is not full and you have not made a reservation, you are welcome to join! We respect the right of first bookers to go to classes.

3) If you have 3 unused bookings or late cancellations, you will lose the right to book hours for 14 days. You can attend classes as a drop-in client, but you do not book them in advance.

5) Be sure to arrive for classes on time (10-15 mins in advance). All participants must perform a warm-up, ie. 5 to 10 minutes of independent breathing and body-warming exercise before the start of the actual class.

6) Warm-up continues at the beginning of the guided class as instructed by the coach.

7) Wear indoor shoes unless training is done outdoors.

Special Terms for Limited Membership:

Limited membership includes 10 guided small group classes per month (excluding private or company classes) according to the current schedule. Classes cannot be carried over to the following months. Limited membership is based on the fact that 10 hours can be used at any time within a month. In this case, the member may, if he or she wishes, practice more frequently in other weeks and take a break from training for other weeks, for example, up to a maximum of 10 times during each month.

Special terms for unlimited membership:

Unlimited membership includes an unlimited number of guided small group training classes (excluding private or company classes) according to the current schedule, as well as access to the gym according to its opening hours.

Special terms for hybrid membership:

Hybrid membership includes an unlimited number of guided small group training classes (excluding private or company classes) according to the current schedule, access to the gym according to its opening hours, a face-to-face meeting with PT on a monthly basis, and a personal training program to support individual development.

Special terms for Beginner’s Course membership:

Beginner’s Course membership begins with training at Idealfysio Oy. Membership includes a face-to-face meeting with the coach, guided technique lessons during the first 2 weeks, a mobility program, and a 4 week orientation period for normal weekly classes. Beginner’s Course membership can begin on pre-determined days when technical lessons start. Start dates are announced on Idealfysio Oy's website. In total, Beginner’s membership lasts for six weeks, after which it ends automatically.

SPECIAL COURSES, EVENTS AND STAFF TRAINING

1) Idealfysio Oy determines all hours, courses and special events and can change them at any time. Customers and members will be notified of changes in fees prior to the date of the change.

2) Idealfysio Oy reserves the right to cancel a reservation for a course or special event, or block the customer's entry by decision of the management.

3) Idealfysio Oy is not responsible for the refund of the booking payment if the receipt is not received at least 7 days in advance before the first hour.

4) Idealfysio Oy is not obliged to return the course fee if the buyer does not want to continue the paid course until the end.

5) The client accepts his / her responsibility to attend the classes according to the schedule.

6) Idealfysio Oy is not responsible for refunds, booking a new training session or booking special events if the cancellation notice is not received at least 24 hours in advance. A personal training session can be re-booked once, subject to timely cancellation, after which it will be counted as used.

PERSONAL TRAINING

Customer and coach responsibilities

After the initial consultation and goal discussion, both the client and the coach have knowledge and understanding of the client's previous training history, current condition, and his or her goals. The client understands that the results depend on the regularity, determination, and continuity of the training, and also on following the instructions given by the coach.

The customer is 100% committed to achieving their own goals. He or she also understands that it is their responsibility to notify the coach if there are any changes in his physical condition that could affect the training. These things can be, for example, injury, illness or other changes related to the state of health (pregnancy, medication).

The coach is 100% committed to supporting, encouraging and guiding the client towards his or her goals. The coach undertakes to ensure the safety of the client during the training by all means available to them and cannot be held responsible for any injuries, accidents or other sudden events that occur during the training that endanger the client's health. The customer is aware of the health risks related to the exercise, both known and unforeseen, and has prepared for them with the relevant insurance.

Cancellation policy

Agreed workouts are held on schedule, and being late for workouts does not mean prolonging your workout beyond a pre-agreed time.

Cancellation of the agreed training time must be made no later than 24 hours before the training start time. Thereafter, canceled appointments are considered used.

If the client does not arrive at the practice site within 15 minutes of the agreed start time, the appointment will be deemed to have been used.

If the coach falls ill or for any other reason has to cancel the agreed appointment, the appointment will be rescheduled.

Special conditions for distance coaching:

Distance coaching contracts are contracts for an indefinite period that include a 2-month commitment at the beginning of the contract. After the first 2 months, the contract can be terminated with one month's notice. In other words, if the customer gives notice to terminate the contract on 15 February, the training will continue until the end of March, if more than 2 months have passed since the start of the remote coaching when the notice of termination is given.

The contract can also be made for a fixed period, in which case both start and end dates are agreed immediately at the time of concluding the contract.

PAYMENTS

The client undertakes to train under the guidance of a Personal Trainer within a pre-agreed schedule. This is further specified in the information in this agreement below. By accepting this agreement, the customer undertakes to pay the agreed monthly installment for the entire agreed period.

If, for one reason or another, the entire agreed amount of training is not used within each month (eg due to illness), those training sessions will be postponed to the end of the training period and thus will not affect the pre-agreed monthly installment.

The customer will be billed at the beginning of each month, unless otherwise agreed. The customer undertakes to pay the price of the entire package as originally agreed. If the invoice is not paid on time, the customer will receive a payment reminder one week after the due date of the invoice. If the payment has still not been made two weeks after the due date, the invoice will be collected by an external collection service.

No fees will be refunded unless there is an emergency, in which case the situation will be reviewed on a case-by-case basis.

Minors (children under 17)

A parent or guardian must complete a parental consent form in addition to normal membership registration. Membership is not valid until the consent form has been signed.

PHYSIOTHERAPY, OMT PHYSIOTHERAPY AND MASSAGE

Treatment and patient data policies:

The start of the care relationship requires that the client gives consent for the storage of his / her patient data and information in the centrally maintained national patient information system.  Physiotherapy service providers such as Idealfysio Oy, and the independent professionals working in the company, are registered to the patient information and must log patient data to this system. The information stored may be disclosed to healthcare professionals who have also joined the system during the care relationship, if the care relationship so requires. The client gives consents to the physiotherapist providing treatment to give feedback about the details of treatment provided to the healthcare professional who referred the client in the case that a referral occurred. 

Patient information is confidential. It can be used in connection with the treatment relationship and with the consent of the client in the physiotherapy facility providing the treatment. Information is disclosed to other parties only where the law requires it or with the customer's permission. If desired, the customer has the opportunity to check the information about him / her stored in Idealfysio Oy's register in connection with any visit or upon written request. Likewise, the customer has the right to demand the correction of incorrect information in the register, to withdraw his consent to the disclosure of the information or to limit it.

4. For what purposes do we process information about you?

4.1 Customers of Idealfysio Oy

Idealfysio Oy processes information about you for the following purposes:

To fulfill obligations to customers, such as invoicing.

To enable standard customer service, such as answering questions and correcting incorrect information. To disclose information and to comply with Idealfysio Oy’s safety and other regulatory requirements.

The data can also be used as a basis for market and customer analysis, marketing research, statistics, business monitoring and the development of business and methods related to bookings and purchases.

5. Criteria for the processing of personal data

5.1 Idealfysio Oy processes your personal data in accordance with the lawful processing criteria described in this section.

5.2 We first process your personal data in order to implement an agreement that you have entered into with us as a customer or as a member of Idealfysio Oy, such as to make reservations and purchases and to manage Idealfysio Oy memberships. In addition, based on this, we will send you, if necessary, important information about exceptions and schedule changes related to the services, or the processing of personal data is based on the person's consent.

6.2 Upon termination of Idealfysio Oy membership, your data will be processed on the same basis and for the same purposes as other Idealfysio Oy customers who are not members of Idealfysio Oy.

7. To whom do we disclose your information?

7.1 Idealfysio Oy may disclose your information to a third party, such as the customer management system used by Idealfysio Oy. Idealfysio Oy may also disclose your information to Idealfysio Oy's partners, such as card and communications service providers. 7.3 Idealfysio Oy may also disclose your personal data if required by applicable law or authorities to protect Idealfysio Oy's legal interests or to detect or prevent fraud and other security or technical issues.

7.4 Idealfysio Oy may transfer your personal data to a country outside the EU / EEA if Idealfysio Oy's partner operates in that country. 11. Your rights

11.2 At your request or on your own initiative, Idealfysio Oy will correct, delete or supplement any incorrect, incomplete or misleading information so that it can no longer identify you.

11.3 If you do not want Idealfysio Oy to process your personal data for marketing purposes, you may notify Idealfysio Oy at any time. Once Idealfysio Oy has received your notification, Idealfysio Oy will stop processing your personal data for this purpose. Idealfysio Oy does not process personal information to target direct marketing to children under the age of 16.

11.4 You have the right to obtain a copy of your information from Idealfysio Oy upon written request, as well as the purpose for which your information will be processed and the recipients to whom your information has been or will be disclosed, from sources other than you, how automatic decision-making (including profiling) how long your data will be kept. At the same time, you have the right to be informed of your rights as the subject of the processing of personal data.

11.5 Under certain conditions, you have the right to have your data transferred to you or, if technically possible, to another service provider. Idealfysio Oy jäsen- ja sopimusehdot

Stadifit (osoitteessa Bulevardi 54, 00120 Helsinki) on osa Idealfysio Oy:tä (2615378-5). Aloittaessasi jäsenyyden Idealfysio Oy:llä tai käyttäessäsi Idealfysio Oyn palveluita, hyväksyt samalla nämä sopimusehdot.

VASTUUVAPAUTUS

1) Kehotamme sinua välttämään sellaisia fyysisiä aktiviteetteja, jotka eivät sinulle terveydellisistä syistä sovi. Jos sinusta tuntuu, että terveydentilassasi on harjoittelua rajoittavia seikkoja, keskustele lääkärisi kanssa ennen harjoittelun aloittamista. Harjoitusohjelmat ja harjoitustilamme on tehty mahdollisimman turvallisiksi, mutta kaikki jäsenet harjoittelevat omalla riskillään. Jäseniltä edellytetään terveydentilan arviointia ja tarvittaessa osallistumista perustekniikoiden opetukseen ennen harjoittelua Idealfysio Oy:ssä.

2) Asiakkaan Idealfysio Oy:lle antama vastuuvapautuslauseke: Asiakas tiedostaa, että hänen ostamansa harjoitteluohjelmat ja ravintovalmennuspalvelut sisältävät raskaita fyysisiä aktiviteetteja, juoksua, painoharjoittelua, kuntopyöräilyä, voimistelua sekä ravinto-ohjelmien noudattamista yms. Asiakas tiedostaa, että näissä fyysisissä aktiviteeteissä on loukkaantumis- ja vahinkoriskejä (mm. sydänkohtaus, lihasvenähdys, luunmurtuma, lämpöhalvaus, polvi-, alaselkä- ja jalkavamma tai muu sairaus). Asiakas vakuuttaa tekevänsä kaiken harjoittelun omalla vastuullaan. Aloittaessaan harjoittelun asiakas vakuuttaa myös, että hän on kykenevä osallistumaan fyysiseen harjoitteluun ja on keskustellut Idealfysio Oy:n henkilökunnan kanssa, mikä on hänelle sopiva harjoittelumuoto ja -ohjelma. Asiakas vakuuttaa ottavansa vastuun ja riskin oman fyysisen kestokykynsä ylittymisestä.

3) Jäsen, hänen perillisensä tai lähimmäisensä luopuvat vaatimuksista sekä vapauttavat Idealfysio Oy:n (sekä minkä tahansa sen omistajan, työntekijän tai muun valtuutetun edustajan, mukaan lukien riippumattomat urakoitsijat) vastuun kaikista vahingoista ja saatavista. 

4) Jäsen suostuu siihen, että kaikki tämän sopimuksen ehdot ovat sitovia jäsenen perillisille, henkilökohtaisille edustajille ja toimeksiantajille.

5) Täytäntöönpanokelpoisuus: Osapuolet ovat yhtä mieltä siitä, että jos jokin tämän sopimuksen määräyksistä on julistettu mitättömäksi ja täytäntöönpanokelvottomaksi, katsotaan tällainen määräys irrotetuksi tästä sopimuksesta, joka muutoin pysyy voimassa. Jäsen hyväksyy kuitenkin, että kaikki ehdot täytetään ja asiakas luopuu nimenomaisesti kaikista laissa säädetystä oikeudesta, mitkä mitätöi tämän sopimuksen määräyksen täytäntöönpanokelpoisuuden.

YLEISET EHDOT

1) Jäsenten tulee aina noudattaa jäsenyyden sääntöjä ja suostua henkilökunnan antamiin kohtuullisiin ohjeistuksiin Idealfysio Oy:n toiminnan, tilojen tarkoituksenmukaisen käytön ja muiden jäsenten mukavuuden varmistamiseksi.

2) Kaikki kustannukset, jotka jäsenille aiheutuvat Idealfysio Oy:ssä vierailun aikana, on maksettava ennen toimitiloista tai tunneilta poistumista, ellei tuotteiden tai palveluiden laskutuksesta ole sovittu erikseen. 

3) Kaikki riidat ja erimielisyydet tulkitsee osapuolia sitovasti Idealfysio Oy:n vastaava henkilö. Tulkintaan tyytymätön voi hakea ratkaisua Helsingin käräjäoikeudesta.

4)  Idealfysio Oy: pidättää oikeuden muuttaa sääntöjä milloin vain ilman erillistä ilmoitusta yksittäisille jäsenille. Jos jokin osio näistä säännöistä ilmoitetaan laittomaksi tai muuten toimeenpanokelvottomaksi, jäljellä olevat säännökset pysyvät voimassa.

TILOJEN KÄYTTÄMINEN

1) Kun asiakas on hankkinut jäsenkortin, hänellä on oikeus käyttää Idealfysio Oy:n tiloja. Idealfysio Oy voi milloin tahansa sulkea kaikki tai osan tilastaan millä tahansa ajanjaksolla ilman ennakkoilmoitusta, mikäli se on tarpeellista, puhdistus-, korjaus-, muutos-, huolto- tai turvatoimista tai niiden ulkopuolisista syistä.

2) Mikäli asiakkaalle käy onnettomuus Idealfysio Oy:n tiloissa, täytyy hänen ilmoittaa onnettomuudesta ja siihen johtaneista olosuhteista henkilökunnan jäsenelle välittömästi onnettomuuden jälkeen.

3) Vaatetuksen tulee aina olla sovelias. 

4) Pääsy kuntosalille ja kurssien varaaminen voidaan tehdä käyttämällä henkilökohtaisia kirjautumistietoja verkkovarausohjelmistossa.

5) Reilusti hikoavia jäseniä kehotetaan toimimaan tavalla, joka ei häiritse muita jäseniä, sekä pyyhkimään laitteet käytön jälkeen.

6) Turvallisuuden ja hygienian takia ruokailuvälineitä, laseja ja astioita ei sallita harjoittelualueilla.

7) Tulipalon sattuessa jäseniä pyydetään poistumaan rauhallisesti käyttäen lähintä uloskäyntiä.

8) Idealfysio Oy, valmentajat, edustajat tai muu henkilökunta (mukaan lukien kaikki itsenäiset toimijat, jotka ovat Idealfysio Oy:n palkkaamia) eivät ole missään olosuhteissa millään tapaa vastuussa jäsenten menetyksistä, vammoista tai onnettomuuksista (mukaan lukien kuolema), vahingossa tai tahallaan aiheutetuista tai muissa olosuhteissa tapahtuneista tapauksista Idealfysio Oy:n tiloja käytettäessä.

9) Tupakointi - Idealfysio Oy:n alueella on tupakointi kielletty.

10) Sosiaaliset tapahtumat - Keskus varaa oikeuden milloin vain ilman ilmoitusta rajata tiloja tapahtumille, jotka rajoittavat tilojen normaalia asiakaskäyttöä.

11) Löytötavarat - Kaikki löytötavarat Idealfysio Oy:n tiloista täytyy toimittaa Idealfysio Oy:n henkilökunnalle. Esineitä säilytetään kuukauden ajan, jonka jälkeen ne lahjoitetaan paikalliseen hyväntekeväisyyteen. Idealfysio Oy:n vastuu asiakkaiden omaisuuden häviämisestä tai vahingoittumisesta rajoittuu vain vahinkoihin ja häviämiseen, joka johtuu yksinomaan Idealfysio Oy:n, sen henkilökunnan ja edustajien huolimattomuudesta. Poikkeuksetta Idealfysio Oy ei ota vastuuta rahasta, arvoesineistä tai muusta jäsenten henkilökohtaisesta omaisuudesta.

12) Idealfysio Oy:n tilojen tahallinen hajottaminen, omaisuuden varastaminen tai väärinkäyttö johtaa välittömään jäsenyyden purkamiseen ja mahdolliseen ilmoitukseen viranomaisille. 

JÄSENYYDET, PALVELUT, HINNOITTELU JA LASKUTUS

1) Mahdollisten hintamuutosten ilmaantuessa hintamuutoksesta ilmoitetaan etukäteen. Asiakas voi halutessaan irtisanoa jäsenyytensä ennen hintamuutoksen voimaantuloa annetun ajanjakson puitteissa.

2) Verkkosivuilla ja niiden ympärillä tarjotut tiedot, palvelut ja tuotteet voivat muuttua ilman ilmoitusta. Varaamme oikeuden perua tarjouksen verkkosivuvirheen tai väärän tiedon osalta. Varaamme myös oikeuden perua kaikki hyväksytyt tilaukset, jotka ovat tehty virheen tai väärän tiedon alaisuudessa. Kaikki tarjotut tuotteet ovat riippuvaisia saatavuudesta.

3) Maksamalla jäsenyysmaksun ja hyväksymällä nämä käyttöehdot, jäsen on oikeutettu käyttämään Idealfysio Oy:n tiloja ja/tai palveluita jäsenyystyypin mukaisella tavalla ja laajuudella.

4) Jäsenyyden maksaminen tehdään joko täytenä maksuna jäsenyyden alussa tai kuukausittain aina seuraava kuukausi etukäteen laskulla maksaen. Mikäli jäsen maksaa jäsenyyttään kuukausittain etukäteen, maksetaan jäsenyyden alkaessa ensimmäisestä harjoituskuukaudesta tasauslasku, joka määräytyy seuraavasti: mikäli jäsenyys alkaa kuun 1.-14. päivä, maksetaan jäsenyyden alkaessa harjoittelumaksu alkamispäivästä kuluvan kuun viimeiseen päivään joko paikan päällä kuntokeskuksessa tai laskulla. Mikäli jäsenyys alkaa kuun 15.-31. päivä, maksetaan jäsenyyden alkaessa harjoittelumaksu joko paikan päällä kuntokeskuksessa tai laskulla alkamispäivästä seuraavan kuun viimeiseen päivään. Tämän jälkeen harjoittelumaksu lähetetään jäsenelle aina kuukausittain etukäteen 14 päivää ennen laskun erääntymistä. Laskun eräpäivä on kuun 1. päivä.

Jos maksua ei suoriteta eräpäivänä, maksumuistutus lähetetään ja jäsenen pääsy salille estetään. Jos maksua ei vastaanoteta 7 päivän sisällä maksuviivästysilmoituksesta, lasku lähetetään ulkoisen toimijan velanperintäpalveluun ja jäsenyys estetään. Jäsenyys avataan uudelleen, kun maksu on vastaanotettu.

5) Jäsenen katsotaan rikkoneen tätä sopimusta, jos hän ei noudata sopimuksen ehtoja mukaan lukien, mutta ei rajoittuen, velvollisuus suorittaa maksut eräpäivänä, kuten yllä on mainittu. Oletuksena Idealfysio Oy:llä on kaikki käytettävissä olevat oikeudet ja oikeussuojakeinot, mukaan lukien tämän sopimuksen irtisanominen ja kaikkien sovellettavien vahinkojen korvaaminen. Jos Idealfysio Oy viivästyy tai pidättyy käyttämästä tämän sopimuksen mukaisia oikeuksia, Idealfysio Oy ei luovuta eikä Idealfysio Oy menetä näitä oikeuksia. Jos Idealfysio Oy hyväksyy jäsenen maksut myöhään tai osittain, Idealfysio Oy ei luovuta oikeutta saada tämän sopimuksen mukaisia maksuja ja muita kuluja.

6) Maksutavat: vastaanotamme käteistä ja useimpia etuusmaksutyyppejä (Smartum, ePassi ja Edenred jne.). Jäsentilin maksut voidaan myös hoitaa e-laskulla, pankkisiirrolla, sekä pankki- tai luottokortilla. 

7) Idealfysio Oy pidättää oikeuden hylätä jäsenyyshakemuksen tai kieltää pääsyn salille johdon harkinnan mukaan.

8) Kun rekisteröit jäsenyytesi, sinulle annetaan kulkulupa. Jos rekisteröit jäsenyytesi verkkosivuillamme, saat kulkuluvan ensimmäisellä vierailulla Idealfysio Oy:ssä. Jos avain (kulkulupa) häviää, uuden avaimen (kulkuluvan) hinta on 10 euroa. Uuden kulkuluvan ostaminen on mahdollista Idealfysio Oy:n vastaanoton aukioloaikana. Kaikkien jäsenten tulee käyttää avainta kuntosalille ja kursseille ilmoittautuessaan joka kerta Idealfysio Oy:llä vieraillessaan. Muista, että avain on vain henkilökohtaiseen käyttöön; et saa tuoda kuntosalille mukanasi henkilöitä, jotka eivät ole jäseniä. Lisäksi turvallisuussyistä et saa avata ovea toiselle henkilölle, vaikka he sanovat olevansa jäseniä. Jos näitä sääntöjä rikotaan, jäsenyys perutaan välittömästi ilman hyvitystä.

9) Jäsenyyden tai palvelun ostaminen Idealfysio Oy:n verkkokaupasta:

Idealfysio Oy:n verkkokaupassa noudatetaan etäkauppalakia. Verkkokauppaoston tekevä asiakas hyväksyy Idealfysio Oy:n voimassa olevat sopimusehdot. Verkkokauppaoston voi peruuttaa 14 päivän sisällä ostotapahtumasta ilmoittamalla peruutuksesta sähköpostitse osoitteeseen asiakaspalvelu@stadifit.com. Tällöin osto perutaan ja asiakkaalle palautetaan hänen verkkokauppaoston yhteydessä maksamansa summa. Peruuttamisoikeus on voimassa, jos asiakas ei ole ottanut palvelua käyttöönsä (tapaamisia valmentajan kanssa ei ole vielä pidetty, kuntosalin kulkulupaa ei ole noudettu tai ohjatuille tunneille ei ole vielä osallistuttu).

JÄSENYYDEN PÄÄTTÄMINEN / KESKEYTTÄMINEN

1)  Idealfysio Oy pidättää itsellään oikeuden kieltää pääsyn ja / tai jäädyttää tai keskeyttää jäsenyyden välittömästi, jos jäsen: a) aiheuttaa Idealfysio Oy:lle häiriötä tai aiheetonta häiriötä muille Idealfysio Oy:n jäsenille tai vieraille b) rikkoo Idealfysio Oy:n sääntöjä tai väärinkäyttää Idealfysio Oy:n tiloja, c) muusta syystä, mikä on vastoin Idealfysio Oy:n sääntöjä tai arvoja.

2) Jäsenen oikeus irtisanoa jäsenyys: Asiakas ei saa irtisanoa tai peruuttaa sopimusta ja nykyistä jäsenyyttä aikaisemmin kuin valitun jäsenyyden asettama määräajan puitteissa, paitsi jos: a) jäsen ei voi kuoleman tai vamman vuoksi hyödyntää täysimääräisesti Idealfysio Oy:n palveluja, joihin jäsen on tehnyt sopimuksen, b) kaikkiin jäsenyyksiin kuuluu 7 päivän riskitön peruuttamisaika. Jos jäsen 7 päivän kuluessa jäsenyyden alkamispäivästä päättää perua palvelun vastaanottamisen, hän saa 100% palautuksen maksetuista rahoista. Mahdolliset palautukset koskevat vain käteis- tai korttimaksuja, ei liikuntaeduilla (ePassi, Smartum jne.) tehtyjä suorituksia.

3) Jäsenellä on oikeus keskeyttää palvelu: jäsenyys voidaan keskeyttää seuraavissa tapauksissa: a) lääketieteellisistä syistä (mikä edellyttää kirjallista lääkärintodistusta ja sitä sovelletaan todistuksen vastaanottopäivästä alkaen). Lääkärintodistus vaaditaan myös kuntoutumisesta. b) Jäsenyystyypin mukaisesti (ks. Erityiset jäsenehdot) c) poikkeuksellisissa olosuhteissa johdon harkinnan mukaan. Kaikki jäsenyyksien keskeytykset tehdään johdon harkinnan mukaan.

ERITYISET EHDOT KUNTOSALIJÄSENILLE JA PIENRYHMÄVALMENNUSJÄSENILLE

Sitoutumisaika

Kuntosali- ja pienryhmävalmennusjäsenyydet ovat toistaiseksi voimassaolevia sopimuksia. Jäsenyys jatkuu automaattisesti toistaiseksi voimassa olevana jäsenyytenä yhden (1) kuukauden irtisanomisajalla.

Jäsenyyden tauotus

Jäsenyyden voi tauottaa maksimissaan kaksi (2) kertaa kalenterivuoden aikana. Tauon minimipituus on neljätoista (14) päivää ja maksimipituus kuusi (6) kuukautta. Taukopyyntö tulee ilmoittaa kirjallisesti sähköpostiosoitteeseen asiakaspalvelu@stadifit.com. Asiakkaille lähetetään seuraavan kuun lasku kuluvan kuun puolivälissä. Mikäli taukopyyntö on ilmoitettu kuun 1.-15. päivä, huomioidaan tauko seuraavassa muodostuvassa laskussa. Mikäli taukopyyntö on ilmoitettu kuun 16.-31. päivä, tulee jo lähetetty lasku maksaa normaalisti. Jo maksetut tauon kanssa päällekkäiset päivät hyvitetään seuraavassa asiakkaalle muodostuvassa laskussa, kun jäsenyys on jälleen aktiivinen. Tauon päätyttyä jäsenyys ja laskutus aktivoituu automaattisesti.

Jäsenyyden irtisanominen

Jäsenyyden voi irtisanoa kuukauden irtisanomisajalla. Mikäli jäsen irtisanoutuu kuun 1.-15. päivä, päättyy jäsenyys saman kuun viimeiseen päivään. Mikäli jäsen irtisanoutuu kuun 16.-31. päivä, päättyy jäsenyys seuraavan kuun viimeiseen päivään. Irtisanomisilmoitus tulee tehdä kirjallisesti sähköpostiosoitteeseen asiakaspalvelu@stadifit.com. Kuntosalin avain (kulkulupa) tulee palauttaa Idealfysio Oy:lle kahden viikon kuluessa jäsenyyden päättymisestä.

Tuntivaraukset

1) Tuntivarauksia voidaan tehdä 5 päivää etukäteen verkkoportaalista. Peruutukset on tehtävä aamun ja aamupäivän tunneille 12 tuntia ennen tunnin alkamista ja iltapäivän ja illan tunneille 6 tuntia ennen tunnin alkamista. 

2) Tunnit perutaan, jos varauksia ei ole tehty varausajan puitteissa. Jos tunti ei ole täynnä etkä ole tehnyt varausta, olet tervetullut mukaan tunnille! Noudatamme ensimmäisten varaajien oikeutta mennä tunneille.

3) Jos sinulla on 3 peruuttamatonta käyttämätöntä varausta tai myöhäistä peruutusta, menetät oikeuden varata tunteja 14 päivän ajan ajaksi. Voit osallistua tunneille drop-in -asiakkaana, mutta et varata niitä etukäteen.

5) Muista saapua tunneille ajoissa (10-15 min aikaisemmin). Kaikkien osallistujien on suoritettava lämmittely, eli 5–10 minuuttia itsenäistä hengästyttävää ja kehoa lämmittävää liikuntaa ennen varsinaisen tunnin alkua.

6) Lämmittely jatkuu ohjatun tunnin alussa valmentajan ohjeistamalla tavalla.

7) Käytä sisäkenkiä, ellei harjoittelu tapahdu ulkona.

Limited-jäsenyyden erityisehdot:

Limited-jäsenyyteen kuuluu 10 mitä vain kulloinkin voimassa olevan aikataulun mukaista ohjattua liikuntatuntia kuukaudessa (poislukien yritys- ja yksityistunnit). Tunteja ei voi siirtää seuraaville kuukausille. Limited-jäsenyys perustuu siihen, että kuukauden sisällä 10 tuntia voi käyttää milloin vain. Tällöin jäsen voi halutessaan harjoitella toisilla viikoilla tiheämmin ja pitää toisilla viikoilla esimerkiksi taukoa harjoittelusta työmatkan vuoksi, kuitenkin yhteensä maksimissaan 10 kertaa kunkin kuun aikana.

Unlimited-jäsenyyden erityisehdot:

Unlimited-jäsenyyteen kuuluu rajoittamaton määrä mitä vain kulloinkin voimassa olevan aikataulun mukaista ohjattua liikuntatuntia (poislukien yritys- ja yksityistunnit) sekä kuntosalin käyttöoikeus sen aukioloaikojen mukaisesti.

Hybrid-jäsenyyden erityisehdot:

Hybrid-jäsenyyteen kuuluu rajoittamaton määrä mitä vain kulloinkin voimassa olevan aikataulun mukaista ohjattua liikuntatuntia (poislukien yritys- ja yksityistunnit), kuntosalin käyttöoikeus sen aukioloaikojen mukaisesti, henkilökohtainen tapaaminen PT:n kanssa kuukausittain sekä henkilökohtaisesti laadittu treeniohjelma tukemaan yksilöllistä kehittymistä.

Beginner’s Course -jäsenyyden erityisehdot:

Beginner’s Course -jäsenyydessä aloitetaan treenaaminen Idealfysio Oy:llä. Jäsenyyteen kuuluu henkilökohtainen aloitustapaaminen valmentajan kanssa, ohjatut tekniikkatunnit ensimmäisten 2 viikon aikana sekä 4 viikon tutustumisjakso normaaleille viikkotunneille. Beginner’s Course -jäsenyyden voi aloittaa ennalta määrättyinä päivinä, jolloin tekniikkatuntijaksot käynnistyvät. Aloituspäivät ilmoitetaan Idealfysio Oy:n verkkosivustolla. Yhteensä Beginner’s -jäsenyys kestää kuusi viikkoa, jonka jälkeen se päättyy automaattisesti.

ERIKOISKURSSIT, TAPAHTUMAT JA PERSONAL TRAINING

1) Idealfysio Oy määrittää kaikki tunnit, kurssit ja erikoistapahtumat ja voi muuttaa niitä milloin vain. Asiakkaille ja jäsenille ilmoitetaan muutoksista maksuissa ennen muutoksen päivämäärää.

2) Idealfysio Oy pidättää oikeuden perua tunnin, kurssin tai erikoistapahtuman varauksen, tai estää asiakkaan pääsyn omistajan päätöksellä.

3) Idealfysio Oy ei ole vastuussa varausten rahojen palauttamisesta, jos kuittausta ei vastaanoteta vähintään 7 päivää etukäteen ennen ensimmäistä tuntia.

4) Idealfysio Oy ei ole velvollinen palauttamaan kurssimaksua, jos ostaja ei halua jatkaa maksamaansa kurssia loppuun.

5) Asiakas hyväksyy vastuunsa osallistua tunneille aikataulun mukaisesti.

6) Idealfysio Oy ei ole vastuussa rahojen palauttamisesta, uuden valmennussession ajan varaamisesta (personal training) tai erikoistapahtumavarauksista, jos ilmoitusta perumisesta ei vastaanoteta vähintään 24 tuntia etukäteen ennen varattua aikaa. Valmennussessio (personal training) voidaan varata kerran uudelleen edellyttäen ajoissa tehtyä peruutusta, jonka jälkeen se lasketaan käytetyksi.

PERSONAL TRAINING 

Asiakkaan ja valmentajan vastuut

Alkukartoituksen ja tavoitekeskustelun jälkeen sekä asiakkaalla että valmentajalla on tieto ja ymmärrys sekä asiakkaan aikaisemmasta treenihistoriasta, sen hetkisestä kunnosta, että hänen tavoitteistaan. Asiakas ymmärtää, että tulokset ovat riippuvaisia harjoittelun säännöllisyydestä, jatkuvuudesta ja valmentajan antamien ohjeiden noudattamisesta.

Asiakas sitoutuu omien tavoitteidensa saavuttamiseen 100 %:sti. Hän myös ymmärtää, että hänen vastuullaan on ilmoittaa valmentajalle, mikäli hänen fyysisessä tilassaan tapahtuu muutoksia, jotka voisivat vaikuttaa harjoitteluun. Näitä asioita voivat olla esim. loukkaantuminen, sairastuminen tai muut terveydentilaan liittyvät muutokset (raskaus, lääkitys).

Valmentaja sitoutuu 100 %:sti tukemaan, kannustamaan ja ohjaamaan asiakasta kohti hänen tavoitteitaan. Valmentaja sitoutuu varmistamaan asiakkaan turvallisuuden treenien aikana kaikin käytössä olevin keinoin, eikä häntä voida pitää vastuussa treenin aikana sattuneista loukkaantumisista, tapaturmista tai muista äkillisistä tapahtumista, jotka uhkaavat asiakkaan terveyttä. Asiakas tiedostaa liikunnan harrastamiseen liittyvät sekä tiedossa olevat että ennalta arvaamattomat terveysriskit ja on varautunut näiden varalta asiaan kuuluvalla vakuutuksella.

Peruutusehdot

Sovitut treenit pidetään aikataulussaan, eikä myöhästyminen treeneistä tarkoita treenin pitenemistä yli ennalta sovitun ajan. 

Sovitun treeniajan peruutus tulee tehdä viimeistään 24 tuntia ennen treenin alkamisaikaa. Tämän jälkeen perutut tapaamiset katsotaan käytetyiksi. 

Jos asiakas ei saavu harjoituspaikalle viimeistään 15 minuutin sisällä sovitusta alkamisajasta, katsotaan tapaaminen käytetyksi.

Jos valmentaja sairastuu tai muusta syystä joutuu peruuttamaan sovitun tapaamisen, sovitaan tapaaminen uuteen ajankohtaan.

Etävalmennusta koskevat erityisehdot

Etävalmennussopimukset ovat toistaiseksi voimassa olevia sopimuksia, joihin sisältyy 2 kuukauden sitoutuminen sopimuksen alussa. Ensimmäisten 2 kuukauden jälkeen, voidaan sopimus päättää yhden kuukauden irtisanomisajalla. Eli esim. jos asiakas antaa ilmoituksen sopimuksen päättämiseksi 15. helmikuuta, jatkuvat treenit maaliskuun loppuun saakka, mikäli etävalmennuksen aloittamisesta on kulunut yli 2 kuukautta irtisanomisilmoitusta annettaessa.

Sopimus voidaan tehdä myös määräaikaiseksi, jolloin sekä aloitus- että päättymis päivämääristä sovitaan jo heti sopimuksen teon yhteydessä.

MAKSUT

Asiakas sitoutuu ennalta sovitun aikataulun puitteissa treenaamaan Personal Trainerin ohjauksessa. Tarkemmin tämä on määritelty tämän sopimuksen tiedoissa alla. Tämän sopimuksen hyväksyessään, asiakas sitoutuu maksamaan sovitun kuukausierän koko sovitulta ajanjaksolta.

Jos koko sovittua treenimäärää ei syystä tai toisesta käytetä kunkin kuukauden sisällä (esim. sairastumisen vuoksi), nuo treenin kerrat siirtyvät treenijakson loppuun eivätkä näin vaikuta ennalta sovittuun kuukausierään.

Asiakasta laskutetaan jokaisen kuun alussa, ellei toisin sovita. Asiakas sitoutuu maksamaan koko paketin hinnan, joka on alunperin sovittu. Jos laskua ei makseta ajallaan, saa asiakas maksumuistutuksen viikon päästä laskun eräpäivästä. Jos maksua ei ole suoritettu kaksi viikkoa eräpäivän jälkeen, menee lasku perintään ulkopuolisen perintäpalvelun toimesta.

Mitään maksuja ei hyvitetä, ellei kyseessä ole hätätapaus, jolloin tilanne käydään läpi tapauskohtaisesti.

Alaikäiset (alle 17-vuotiaita lapset)

Vanhemman tai huoltajan täytyy täyttää vanhempien suostumuslomake normaalin jäsenyysrekisteröitymisen lisäksi. Jäsenyys ei ole pätevä ennen kuin suostumuslomake on allekirjoitettu.

FYSIOTERAPIA, OMT-FYSIOTERAPIA JA HIERONTA

Hoitosuhde ja potilastiedot

Hoitosuhteen käynnistyminen edellyttää, että asiakas antaa suostumuksensa potilastietojensa tallentamiseen Idealfysio Oy:n ja yhtiössä työskentelevien itsenäisten ammatinharjoittajien käyttämään keskitetysti ylläpidettyyn fysioterapialaitosten potilastietojärjestelmään. Tiedot voidaan luovuttaa hoitosuhteen aikana rekisteriin liittyneille terveydenhuollon ammattilaisille, mikäli hoitosuhde niin edellyttää. Asiakas antaa suostumuksensa sille, että hoitava terapeutti antaa hoidosta palautteen lähetteen antaneelle taholle.

Potilastiedot ovat salassa pidettäviä. Niitä voidaan käyttää hoitosuhteeseen liittyen ja asiakkaan suostumukseen perustuen hoitoa antavassa fysioterapialaitoksessa. Muille tahoille tietoja luovutetaan vain lakiin perustuen tai asiakkaan luvalla. Asiakkaalla on halutessaan mahdollisuus tarkistaa Idealfysio Oy:n rekisteriin talletetut, häntä koskevat tiedot käynnin yhteydessä tai kirjallisella pyynnöllä. Samoin asiakkaalla on oikeus vaatia korjattavaksi rekisterissä oleva virheellinen tieto, peruuttaa antamansa suostumus tietojen luovuttamiseen tai rajata sitä.

TIETOSUOJAA JA MARKKINOINTIA KOSKEVA KÄYTÄNTÖ

1. Yleistä

1.1 Tämä tietosuojaa ja markkinointia koskeva käytäntö (”Tietosuojakäytäntö”) kuvailee, miten Idealfysio Oy (Y-tunnus 2615378-5, Bulevardi 54 00120 Helsinki, asiakaspalvelu@stadifit.com) “Idealfysio Oy” tai myös ”me”) rekisterinpitäjänä kerää, käyttää, luovuttaa ja tallentaa henkilötietojasi.

1.2 Tietosuojakäytäntöä sovelletaan henkilötietojesi käsittelyyn silloin, kun Idealfysio Oy tarjoaa sinulle palveluja ja tuotteita. 

1.3 Voit tuntea olosi aina turvalliseksi luovuttaessasi meille henkilötietojasi. Tällä Tietosuojakäytännöllä haluamme osoittaa, miten varmistamme henkilötietojesi käsittelyn voimassa olevan henkilötietolainsäädännön mukaan.

2. Milloin keräämme henkilötietoja ja miten henkilötiedot kerätään?

2.1 Idealfysio Oy kerää ja käsittelee sinua koskevia henkilötietoja, kun ostat Idealfysio Oy:n palveluja ja tuotteita, teet ostoksia Idealfysio Oy:n Internet-sivuilla, käytät Idealfysio Oy:n tarjoamia sovelluksia tai kun otat muulla tavalla yhteyttä Idealfysio Oy:n. Sinusta varausten ja ostojen yhteydessä kerättäviä tietoja tarvitaan, jotta voit solmia sopimuksen Idealfysio Oy:n kanssa ja jotta Idealfysio Oy voi tarjota sinulle palveluja ja tarjouksia.

2.2 Jos olet Idealfysio Oy:n jäsen, Idealfysio Oy kerää sinua koskevia henkilötietoja palvelusopimuksen teon yhteydessä. Idealfysio Oy kerää sinua koskevia tietoja myös jäsenyytesi aikana ja käsittelee tietoja, joita Idealfysio Oy:n saataville kulloinkin tarjotaan jäsentilisi kautta. Jäsenenä voit milloin tahansa päivittää antamiasi henkilötietoja ”Omien sivujesi” kautta. 

3. Mitä tietojasi käsittelemme?

3.1 Idealfysio Oy:n asiakkaat

Kun teet asiakkaana ostoksia ja varauksia, Idealfysio Oy kerää ja käsittelee sinusta seuraavia henkilötietoja:

Tunnistetiedot, kuten nimi, syntymävuosi ja sukupuoli

Yhteystiedot, kuten osoite, puhelinnumero ja sähköpostiosoite

Maksutiedot

Asiakasnumero

IP-osoite ja muut tiedot, jotka koskevat Idealfysio Oy:n Internet-sivujen tai sovelluksen käyttöä. Evästeiden tallentamiseen ja niiden kautta kerättäviin tietoihin sovelletaan Idealfysio Oy:n evästekäytäntöä.

Muut tiedot, joita voit itse ilmoittaa palvelusopimuksen yhteydessä, kuten lähiomaisen yhteystiedot hätätilanteen sattuessa.

4. Mihin tarkoituksiin käsittelemme sinua koskevia tietoja?

4.1 Idealfysio Oy:n asiakkaat

Idealfysio Oy käsittelee sinua koskevia tietoja seuraaviin tarkoituksiin:

  • Asiakkaisiin kohdistuvien velvoitteiden, kuten laskutuksen suorittamiseksi. 

  • Tavanomaisen asiakaspalvelun, kuten kysymyksiin vastaamisen ja virheellisten tietojen korjaamisen mahdollistamiseksi. Tietojen luovuttamiseksi ja Idealfysio Oy:n turvallisuusvaatimusten ja muiden säädösten mukaisten vaatimusten täyttämiseksi.

  • Tietoja voidaan myös käyttää perustana markkina- ja asiakasanalyyseille, markkinointitutkimuksille, tilastotiedoille, liiketoiminnan seurannalle sekä varauksiin ja ostoksiin liittyvän liiketoiminnan ja menetelmien kehittämiselle 

5. Henkilötietojen käsittelyperusteet 

5.1  Idealfysio Oy käsittelee henkilötietojasi tässä osassa kuvatuin lainmukaisin käsittelyperustein.

5.2 Käsittelemme henkilötietojasi ensinnäkin sellaisen sopimuksen täytäntöönpanemiseksi, jonka olet solminut kanssamme asiakkaana tai Idealfysio Oy:n jäsenenä, kuten suorittaaksemme varauksia ja ostoksia sekä hallinnoidaksemme Idealfysio Oy:n jäsenyyksiä. Lisäksi tällä perusteella lähetämme tarvittaessa sinulle tärkeitä tietoja palveluihin liittyvistä poikkeuksista ja aikataulumuutoksista tai henkilötietojen käsittely perustuu henkilön antamaan suostumukseen.

5.3 Tietyissä tapauksissa Idealfysio Oy:llä on lainsäädännöstä johtuva velvollisuus käsitellä henkilötietojasi. Tämä koskee esimerkiksi asiakasrekisterin laatimista ja ylläpitämistä.

6. Kauanko säilytämme sinua koskevia tietoja? 

6.1 Henkilötietojasi säilytetään vain niin kauan, kuin niitä on tarpeen säilyttää niihin tarkoituksiin, joihin tietoja kerätään tämän Tietosuojakäytännön mukaisesti. Idealfysio Oy säilyttää tiedot pidempään, jos se on tarpeen lakisääteisten vaatimusten noudattamiseksi tai Idealfysio Oy:n juridisen edun valvomiseksi, jos esimerkiksi meneillään on oikeudenkäynti. Henkilötietoja käsitellään vain tarpeellisen ajan, asiakkuuden ollessa voimassa tai asiakkuuden päätyttyä välttämättömistä syistä.

6.2 Idealfysio Oy:n jäsenyyden päättymisen jälkeen tietojasi käsitellään samoin perustein ja samoihin tarkoituksiin kuin muidenkin sellaisten Idealfysio Oy:n asiakkaiden, jotka eivät ole Idealfysio Oy:n jäseniä.

7. Kenelle luovutamme tietojasi? 

7.1 Idealfysio Oy voi luovuttaa tietojasi kolmannelle osapuolelle, kuten Idealfysio Oy:n käyttämälle asiakashallintajärjestelmälle. Idealfysio Oy voi myös luovuttaa tietojasi Idealfysio Oy:n yhteistyökumppaneille, esimerkiksi kortti- ja viestintäpalveluja tarjoaville toimittajille. Idealfysio Oy voi myös luovuttaa tietojasi osoitepäivityspalveluja tarjoaville yrityksille varmistaakseen, että meillä on hallussamme oikeat osoitetietosi.

7.2 Sellaiset kolmannet osapuolet, joille Idealfysio Oy luovuttaa tietojasi tai muulla tavalla tarjoaa tietoja sinusta asiakkaana tai jäsenenä ja jotka käsittelevät tietoja Idealfysio Oy:n lukuun, eivät saa luovuttaa tietojasi muille ilman hyväksyntääsi. Vastaanottaja saa käyttää tietoja ainoastaan myydäkseen ja markkinoidakseen Idealfysio Oy:n ja Idealfysio Oy:n yhteistyökumppanin palveluja ja tuotteita tai tarkoituksenaan toimittaa palveluja, jotka liittyvät Idealfysio Oy:n ja Idealfysio Oy:n jäsenen välille solmittuun sopimukseen. Silloin kun tietoja luovutetaan kolmansille osapuolille tällaisten tahojen omia tarkoituksia varten (kuten Idealfysio Oy:n käyttämät applikaatiot), tällaiseen kolmannen osapuolen suorittamaan henkilötietojen käsittelyyn sovelletaan kyseisen kolmannen osapuolen tietosuojakäytäntöjä. Idealfysio Oy ei ole vastuussa tällaisten kolmansien osapuolten suorittamasta henkilötietojen käsittelystä.

Idealfysio Oy:n verkkosivuilla käytetään seuraavia työkaluja: Google Tag Manager, Google Fonts, Google Analytics, Google Ads conversion tracking ja Facebook Ads conversion tracking.

7.3 Idealfysio Oy voi lisäksi luovuttaa henkilötietojasi, mikäli voimassa oleva lainsäädäntö tai viranomaiset niin edellyttävät Idealfysio Oy:n juridisen edun suojelemiseksi tai petosten ja muiden turvallisuutta koskevien tai teknisten ongelmien paljastamiseksi tai estämiseksi.

7.4 Idealfysio Oy voi siirtää henkilötietojasi EU:n/ETA:n ulkopuoliseen maahan, jos Idealfysio Oy:n yhteistyökumppani toimii kyseisessä maassa. Jos henkilötietojasi siirretään EU:n/ETA:n ulkopuoliseen maahan, Idealfysio Oy huolehtii siitä, että henkilötietojen siirrossa EU:n/ETA:n ulkopuolisiin maihin noudatetaan tietosuojasääntelyssä asetettuja vaatimuksia.

7.5 Tietoja säilytetään ainoastaan sähköisessä muodossa. Tietoihin pääsevät käsiksi ainoastaan ne, joilla on tarvetta käsitellä tietoja sopimusvelvoitteiden täyttämiseksi tai suostumukseen perustuvien velvoitteiden täyttämiseksi.

8. Tietosuojakäytännön muutokset

8.1 Idealfysio Oy:llä on oikeus muuttaa Tietosuojakäytäntöä milloin tahansa, jos tietojen käsittelyssä tapahtuu muutoksia. Idealfysio Oy ilmoittaa sinulle Tietosuojakäytännön muutoksista kohtuullisella varoitusajalla. 

9. Henkilötietojen suojaus 

9.1 Voit tuntea olosi aina turvalliseksi luovuttaessasi meille henkilötietojasi. Idealfysio Oy on ryhtynyt tarvittaviin turvallisuustoimiin suojatakseen henkilötietojasi luvattomalta käytöltä, muuttamiselta ja poistamiselta.

Esimerkiksi kaikki asiakkaita ja Idealfysio Oy:n jäseniä koskevat tiedot säilytetään tietokannassa, joka on suojattu käytön valvonnalla ja palomuurilla.

10. Omistajuuden muutokset tai vaihdokset

10.1 Hyväksymällä tämän sopimuksen, hyväksyt ja tiedostat myös sen, että omistajan vaihdoksen tai muun yrityksen omistajuuteen liittyvän muutoksen yhteydessä, kuten yritysfuusion tai yrityskaupan yhteydessä sinun henkilötiedot voidaan siirtää voimassa olevaa lakia noudattaen. 

11. Sinun oikeutesi 

11.1 Idealfysio Oy vastaa siitä, että henkilötietojasi käsitellään voimassa olevan lainsäädännön mukaisesti. Jos katsot, että henkilötietojesi käsittelyssä ei noudatettu soveltuvaa tietosuojasääntelyä, voit tehdä valituksen toimivaltaiselle tietosuojaviranomaiselle eli Suomessa tietosuojavaltuutetulle.

11.2 Idealfysio Oy korjaa, poistaa tai täydentää pyynnöstäsi tai omasta aloitteestaan virheelliset, puutteelliset tai harhaanjohtavat tiedot tai muuttaa niitä niin, ettei niistä voida enää sinua tunnistaa.

11.3 Jos et halua, että Idealfysio Oy käsittelee henkilötietojasi markkinointitarkoituksessa, voit milloin tahansa ilmoittaa asiasta Idealfysio Oy:lle. Kun Idealfysio Oy on vastaanottanut ilmoituksesi, Idealfysio Oy lopettaa henkilötietojesi käsittelyn tässä tarkoituksessa. Idealfysio Oy ei käsittele henkilötietoja kohdistaakseen suoramarkkinointia alle 16-vuotiaille lapsille.

11.4 Sinulla on oikeus saada kirjallisesta hakemuksesta Idealfysio Oy:lta jäljennös sinua koskevista tiedoista sekä tieto siitä, mihin tarkoitukseen tietojasi käsitellään ja mille vastaanottajille tietojasi on luovutettu tai aiotaan luovuttaa, mistä muista lähteistä kuin sinulta tietojasi on kerätty, miten automaattista päätöksentekoa (mukaan luettuna profilointia) suoritetaan ja kuinka kauan tietojasi säilytetään. Sinulla on myös samalla oikeus saada tiedot oikeuksistasi henkilötietojen käsittelyn kohteena.

11.5 Sinulla on tietyin edellytyksin oikeus saada tietosi siirretyksi sinulle tai, jos se on teknisesti mahdollista, toiselle palveluntarjoajalle. Tämä oikeus koskee tietoja, jotka sinä olet antanut Idealfysio Oy:lle ja joita on käsitelty sinun ja Idealfysio Oy:n välisen sopimuksen täytäntöön panemiseksi.

11.6 Sinulla on oikeus pyytää tietojesi poistamista, jos (i) tietoja ei tarvita enää niihin tarkoituksiin, joita varten niitä kerättiin, (ii) vastustat tietojesi käsittelyä suoramarkkinointitarkoituksiin (mukaan lukien profilointia suoramarkkinointitarkoituksiin), (iii) käsittely on perustunut suostumukseesi ja peruutat suostumuksesi tai (iv) tietojasi on käsitelty lainvastaisesti. Huomaathan, että voimme kuitenkin säilyttää tietojasi, mikäli se on tarpeen Idealfysio Oy:n lakisääteisen velvoitteen noudattamiseksi tai oikeudellisen vaateen laatimiseksi, esittämiseksi tai puolustamiseksi.

12. Internetsivuillamme vierailua koskevat erityisehdot 

12.1 Internetsivuillamme voi olla linkkejä tai upotteita muihin sinua kiinnostaviin sivustoihin tai palveluihin. Kun käytät näitä linkkejä tai upotteita, ymmärrät että nämä sivustot eivät ole meidän hallittavissamme. 13. Markkinointia koskevat erityisehdot 

13.1 Osallistuessasi Idealfysio Oy:n järjestämiin aktiviteetteihin sinua saatetaan kuvata tai videoida. Tämän sopimuksen yhteydessä, luovutat meille valtuudet käyttää näitä kuvia/videoita ilman erillistä korvausta. Näitä kuvia/videoita käytämme markkinointitarkoituksiin internetsivuillamme, sosiaalisen median kanavissa (kuten Facebook- ja Instagram-tileillämme), tai muissa vastaavissa markkinointitarkoituksissa, ellei toisin sovita.

14. Eurooppalainen verkkovälitteinen riidanratkaisufoorumi (ODR)

1. Johdanto

1.1. Eurooppalainen verkkovälitteinen riidanratkaisufoorumi (ODR) on Euroopan komission ylläpitämä sivusto, jonka avulla verkko-ostamisesta pyritään tekemään turvallisempaa ja reilumpaa tarjoamalla mahdollisuus asianmukaiseen riidanratkaisuun. Kaikkien EU:n, Islannin, Liechtensteinin tai Norjan vähittäismyyjien ja elinkeinonharjoittajien on annettava helposti saatavilla oleva linkki verkkovälitteiselle riidanratkaisufoorumille ja sähköpostiosoite, johon verkkovälitteinen riidanratkaisufoorumi voi ottaa yhteyttä (asetuksen (EU) N:o 524/2013 14 artikla). Se määrittelee menettelytavat riitojen ratkaisemiseksi, jotka saattavat syntyä Idealfysio Oy:n ("me," "meidän," tai "meidän") ja käyttäjiemme välillä.

2. ODR-alusta

2.1. Tiedotamme käyttäjillemme Euroopan komission Online-riitojenratkaisufoorumin (ODR-alusta) olemassaolosta. ODR-foorumi on suunniteltu auttamaan riitojen ratkaisemisessa kuluttajien ja verkkokauppiaiden tai palveluntarjoajien välillä itsenäisen ja puolueettoman riidanratkaisuprosessin kautta.

3.2. ODR-alustaa voidaan käyttää riitojen ratkaisemiseen, jotka syntyvät verkkosopimuksista kuluttajien ja meidän välillä.

5. Sitoumuksemme

5.1. Olemme sitoutuneet osallistumaan ODR-prosessiin hyvässä yhteistyössä ja ratkaisemaan riidat ODR-alustan kautta.

6. Sovellettava laki

6.1. Nämä ODR-menettelyt ja tämä lauseke ovat Suomen lakien alaisia.

7. Muutokset

7.1. Pidätämme oikeuden muuttaa tai päivittää tätä ODR-lauseketta tarvittaessa. Kaikki muutokset ovat luettavissa tällä sivustolla.

8. Voimaantulo

8.1. Tämä ODR-lauseke on voimassa 10.10.2023 alkaen.
